COMPETITION TERMS AND CONDITIONS

  1. COMPETITION OVERVIEW
  2. Magner Properties Pty Ltd (“the Agency”), a registered estate agency with the Property Practitioners Regulatory Authority, holding Fidelity Fund Certificate Number F142604, along with its agents (“Agents”), is hosting the “Exclusive Mandate – Win Your Commission Back!” competition (“the Competition”). The Competition will run from 1 March 2025 to 1 September 2025 (“the Competition Period”).
  3. Property sales that meet the eligibility criteria and are concluded through an exclusive sole mandate with the Agency during the Competition Period will be automatically entered into a lucky draw.
  4. Within 30 days after the Competition Period ends, a lucky draw will be conducted, and one winner (“the Competition Winner”) will receive a refund of their commission (including VAT) via EFT, subject to the Terms and Conditions outlined below. The winner’s details will be announced online as per clause 5.2.
  5. ELIGIBILITY & PARTICIPATION
  6. To qualify for entry into the lucky draw, the following conditions must be met:
    1. The seller must grant an exclusive sole mandate to an Agent to sell their property during the Competition Period.
    2. The property must be sold within the Competition Period and the sale agreement must become unconditional (i.e., all suspensive conditions must be met) within the Competition Period. However, transfer and registration do not need to be completed during this time.
    3. Sales transactions that meet the criteria above will be classified as “Eligible Transactions.”
  7. Each Eligible Transaction qualifies as one entry into the lucky draw. Entries are automatic upon meeting the eligibility requirements.
  8. There are no limitations on:
    1. The type of immovable property;
    2. The commission amount payable to the Agency under the exclusive sole mandate;
    3. The final sale price;
    4. The length of the exclusive sole mandate, provided it falls within the Competition Period.
  9. Only property owners within the 7441 area code are eligible to enter. This applies to both individuals and legal entities, whether residing in South Africa or abroad. If the Competition Winner resides outside South Africa, they must provide a South African bank account for payment.
  10. PRIZE DETAILS
  11. The cash prize is equivalent to the commission (including VAT) paid to the Agency upon transfer of the property.
  12. The prize will be paid within 14 days after:
    1. The lucky draw has taken place; and
    2. The registration of transfer of the property.
  13. The winner is responsible for any applicable taxes in any jurisdiction related to the prize.
  14. If the winner is unable to accept the prize, it will be forfeited.
  15. The prize is non-exchangeable, non-transferable, and cannot be substituted.
  16. The winner will be contacted using the details provided in the sale transaction.
  17. The winner must confirm acceptance of the prize in writing and provide banking details as required by Magner Properties.
  18. If the property has multiple owners, the prize will be paid into the bank account furnished to the transferring attorney.
  19. If multiple agents were involved and the commission was split, only the portion earned by Magner Properties will be refunded as the prize.
  20. PRIVACY & PUBLICITY
  21. The winner may be required to allow the Agency to use their name and/or image for marketing and promotional purposes. If they do not wish to participate, they must notify the Agency in writing within 5 days of being declared the winner. If no such objection is received, it will be assumed that permission has been granted.
  22. DISPUTE RESOLUTION & LEGAL JURISDICTION
  23. Any disputes regarding the Competition or these Terms and Conditions will be resolved at the sole discretion of Magner Properties, whose decision will be final and binding. No correspondence will be entered into.
  24. These Terms and Conditions are governed by the laws of South Africa.
  25. GENERAL CONDITIONS
  26. Any participant found to have engaged in fraudulent, dishonest, or unlawful behavior, or to have violated these Terms and Conditions, may be disqualified at the Agency’s discretion.
  27. The winner will be chosen at random from all eligible entries. The draw result is final and binding.
  28. Participation in the Competition constitutes agreement to abide by these Terms and Conditions and the decisions of Magner Properties.
